Аннотация:
Раскрывается роль и значение полномочий Президента РФ как главы государства. Исследуются вопросы, отнесенные к компетенции Президента РФ в законодательной, исполнительной и судебной ветви власти. Основной акцент делается на рассмотрении правовых актов Президента РФ. Делаются обоснованные выводы о том, правовые акты Президента РФ занимают особое место в системе источников российского конституционного права. Посредством издания указов и распоряжений Президент РФ осуществляет государственное руководство, реализует свои конституционные полномочия. Анализируются труды ведущих ученых, внесших существенный вклад в понимание и развитие принципа разделения властей, реализацию полномочий главы государства в системе органов власти. Подчеркивается необходимость решения проблемы соотношения актов Парламента РФ с актами Президента РФ. Сделан вывод, что вопросы компетенции Президента РФ должны быть изложены в рамочном Федеральном конституционном законе, что способствовало бы возможности контроля за деятельностью Президента РФ не только с позиции иных органов власти, но и общественному контролю со стороны гражданского общества.

Constitutional and Legal Authorities of the President of the Russian Federation: In Search of Limits
Annotation
The role and importance of the powers of the Russian President as the head of state are revealed. The author studies the issues related to the competence of the President of the Russian Federation in the legislative, Executive and judicial branches of power. The main focus is on the consideration of legal acts of the President of the Russian Federation. Justified conclusions are made that the legal acts of the President of the Russian Federation occupy a special place in the system of sources of Russian constitutional law. Through the issuance of decrees and orders, the President of the Russian Federation exercises state leadership and exercises his constitutional powers. The works of leading scientists who have made a significant contribution to the understanding and development of the principle of separation of powers, the implementation of the powers of the head of state in the system of authorities are analyzed. Stresses the need to solve the problem of correlation of the acts of Parliament of the Russian Federation acts of the Russian President. It is concluded that the issues of competence of the President of the Russian Federation should be set out in the framework of the Federal constitutional law, which would contribute to the possibility of monitoring the activities of the President not only from the position of other authorities, but also public control by civil society.
