Аннотация
Статья представляет собой рецензию на диссертацию на соискание ученой степени кандидата юридических наук М. А. Удодовой «Механизм воздействия судебной практики на законодательство», в которой исследуются аспекты воздействия судебной практики на законодательство. Основная мысль автора диссертации заключается в том, что ввиду повышения в настоящее время роли судебной практики для совершенствования законодательства возможно говорить о формировании механизма воздействия судебной практики на законодательство. При формировании соответствующего механизма автором диссертации
предлагается выделение трех последовательных стадий, каждая из которых состоит из взаимосвязанных структурно-функциональных элементов: выявление пробела в праве либо сферы общественных отношений, нормативное регулирование которой отсутствует в законодательств; совокупность различных способов систематизации правоположений образует вторую стадию механизма, включая формулирование
правоположений, которые в дальнейшем различными способами могут быть использованы для совершенствования законодательства; учет судебной практики в законодательном процессе. В статье отмечаются актуальность и комплексность проведенного исследования, логичное и последовательное изложение сути
исследования, новаторство в решении проблемы, умение донести в понятной форме суть научных результатов, высокий теоретический уровень работы, ее теоретическая и практическая значимость.

Abstract
The article is a review of the thesis for the degree of candidate of legal Sciences M. A. Udodova «The mechanism of the impact of judicial practice on the legislation», which examines the aspects of the impact of judicial practice on the legislation. The main idea of the author of the dissertation is that in view of increasing the role of judicial practice to improve the legislation, it is possible to talk about the formation of the mechanism of
influence of judicial practice on the legislation. In the formation of the corresponding mechanism, the author of the dissertation proposes the allocation of three successive stages, each of which consists of interrelated structural and functional elements: the identification of a gap in the law or the sphere of social relations, the normative
regulation of which is absent in the legislation; a set of different ways to systematize the legal provisions forms the second stage of the mechanism, including the formulation of legal provisions, which in the future can be used in various ways to improve the legislation; accounting of judicial practice in the legislative process. The article notes the relevance and complexity of the study, logical and consistent presentation of the essence of the study,
innovation in solving the problem, the ability to convey in an understandable form the essence of scientific results, a high theoretical level of work, and its theoretical and practical significance.
